A
No Win No Fee Agreement is a favourable method of
funding a claim for personal injury.
We are prepared to handle cases on a no-win no-fee basis as long as we think there are reasonable prospects of success.
This means that you will only be responsible for
our fees if the case is won, and in practice these are almost always
recovered from the other side anyway.
If your opponent refuses to settle your case, makes unreasonable offers or simply delays unreasonably in dealing with your claim,
you have the option if rasing a court action.
We will only recommend raising a court action if, in our opinion, there are reasonable prospects of success. In those circumstances,
we will be happy to continue handling your case on a no-win no-fee basis.
Where we require to raise a court action on your behalf, we are entitled to charge you a "success fee". This is to reflect the risk
that we are taking in the event that the claim is unsuccessful, and the fact that we are paying your outlays as the case proceeds.
If we wish to charge a success fee, this will be agreed with you in advance, i.e. before the court action is raised.
Additionally, if necessary we will be
able to arrange an
insurance policy which will cover you for any expenses to be paid
to the other side in the unlikely event that your claim is not
successful. In that case, you will be required to pay an insurance premium which cannot be recovered from your opponent,
even if your claim is successful.
